Welcome to HydraBoats. These Terms and Conditions govern your access to and use of the hydraboats.com website, as well as the booking of boat rental services and nautical experiences offered by HydraBoats in Málaga, Costa del Sol.
By accessing the website, browsing the fleet, making a booking, or creating an account, you agree to be bound by these terms in their current version. If you do not agree, you must not use our services.
HydraBoats acts as an intermediary platform between customers ("the Customer") and the boat owners or operators ("the Owner"). The direct contractual relationship for each booking is established between the Customer and the relevant Owner.
HydraBoats offers an intermediary service for the rental of recreational boats, with or without a skipper, as well as curated nautical experiences in the province of Málaga. All services are subject to availability and prior confirmation.
The boats published on our platform may have different requirements: some require an official boating license, others do not. The Customer is responsible for verifying that they meet the requirements before booking. HydraBoats offers the option to hire a skipper when available for the vessel.
We reserve the right to modify, suspend, or discontinue any service at any time without prior notice, provided that already confirmed bookings are not affected.
To make a booking, the Customer must complete the booking form indicating the vessel, date, duration, and number of people. The booking is registered as a draft until payment is completed or the required documentation is submitted.
The confirmation process varies by vessel type: (a) License-free vessels: the booking is confirmed after full payment is processed through Stripe; (b) Licensed vessels: the Customer must upload proof of their boating license, which will be reviewed by our team. Payment is enabled once the document is approved.
HydraBoats will send a confirmation email with booking details, meeting point, and boarding instructions. It is the Customer's responsibility to provide a valid email address and to review the confirmation.
Bookings that are not paid within the established period or whose documentation is not completed in a timely manner may be automatically cancelled.
All prices are displayed in euros (EUR) and include applicable VAT unless stated otherwise. Prices may vary depending on season, duration, vessel type, and selected extras.
Payment is processed through Stripe, a secure payment provider that complies with PCI-DSS standards. HydraBoats does not store or have access to the Customer's full bank card details.
The charge is made at the time of payment confirmation, except in cases requiring prior document validation. HydraBoats reserves the right to apply peak season surcharges or additional service fees not included in the base rate.
Stripe may temporarily hold a security deposit for certain bookings. This deposit will be released according to Stripe's and the Owner's conditions.
Cancellation policies may vary depending on the vessel, booking type, and season. The applicable policy is shown before payment confirmation and forms part of the booking contract.
As a general rule: (a) Cancellations more than 7 days before departure: 100% refund minus administrative fees; (b) Cancellations between 7 and 3 days before departure: 50% refund; (c) Cancellations less than 3 days before departure: no refund.
HydraBoats reserves the right to cancel a booking due to force majeure, adverse weather conditions, or unforeseen vessel unavailability. In such cases, the Customer will be offered a full refund or a free date change.
The Owner may cancel the booking if the Customer fails to meet licensing requirements, fails to provide the required documentation, or breaches the vessel's terms of use. In such cases, the standard cancellation policy applies.
Refunds are processed through Stripe and may take 5 to 10 business days to be credited, depending on the Customer's bank.
The Customer agrees to: (a) provide truthful and up-to-date information on the booking form; (b) comply with all legal and licensing requirements for navigation; (c) arrive at the port 15 minutes before the agreed departure time; (d) follow safety rules on board and obey the skipper's or Owner's instructions; (e) not exceed the maximum passenger capacity stated for each vessel; (f) use the vessel appropriately and return it in the same condition as received.
The Customer is liable for any damage caused to the vessel during the rental period due to negligent use, failure to follow instructions, or violation of navigation rules. The Owner may pass on the cost of necessary repairs.
Excessive alcohol consumption on board is prohibited, as is the possession or use of narcotic substances. Breach of this rule will result in immediate cancellation without refund, and the Owner may terminate the trip.
HydraBoats acts as an intermediary platform and shall not be liable for direct or indirect damages arising from: (a) the use or inability to use the website; (b) the conduct of the Owner or skipper; (c) weather conditions preventing navigation; (d) technical breakdowns of the vessel; (e) loss or damage to the Customer's personal belongings during the experience.
HydraBoats' liability in connection with any booking is limited to the total amount paid by the Customer for that booking. Nothing in these terms excludes or limits liability for fraud, gross negligence, or personal injury caused by negligence.
All vessels carry the mandatory insurance and undergo the periodic inspections required by Spanish maritime law. The Owner is responsible for the maintenance and safety of the vessel.
These Terms and Conditions are governed by Spanish law. Any dispute arising from the use of the website or the services contracted shall be submitted to the courts of Málaga, with express waiver of any other jurisdiction.
